This revision petition is
directed against the
judgment dated 06.05.2022 passed in Criminal Appeal No.92/2019 by II Additional District and Sessions Judge and Special Judge, Davanagere, whereunder the judgment of conviction dated 18.09.2019 passed in C.C.No.574/2016 by III Additional Senior Civil Judge and JMFC, Davanagere, convicting the petitioner for offence under Section 138 of Negotiable Instruments Act and sentencing him to pay fine of Rs.95,000/- and in default, to undergo simple imprisonment for a period of three months has been affirmed.

Learned counsel for petitioner and learned counsel for respondent are present.

Learned counsel for the petitioner submits that, the petitioner-accused has deposited Rs.47,500/- towards fine amount out of total fine amount of Rs.95,000/-. He further submits that, the petitioner-accused will deposit balance fine amount of Rs.47,500/- within three months. To that effect, the affidavit of petitioner is filed.
4. In paragraph No.3 of the affidavit, the petitioner-accused has stated that, he will pay the balance fine amount of Rs.47,500/- to respondent within three months from this day.
5. In paragraph No.4 of the affidavit, the petitioner-accused has stated that, if he fails to pay the balance fine amount of Rs.47,500/- within three months, he is ready and willing to abide the judgment passed by the trial Court.

Learned counsel for the respondent submits that, he has no objection to record the said affidavit

wherein, the petitioner-accused is undertaking to deposit balance fine amount and dispose of the matter.
7. In view of the petitioner-accused undertaking to pay balance fine amount of Rs.47,500/- with three months, this Criminal Revision Petition is disposed of recording the same.
8. The petitioner-accused shall deposit balance fine amount of Rs.47,500/- before the trial Court within three months from this day. If the petitioner-accused fails to deposit the said balance fine amount before the trial Court, the respondent-complainant is at liberty to enforce the judgment passed by the trial Court.
9. The respondent-complainant is permitted to withdraw Rs.47,500/- deposited by the petitioner-accused before the trial Court. The respondent shall furnish his bank account details, so as to enable the trial Court to transfer the amount deposited by the petitioner-accused directly to bank account of the respondent.

10. Registry is directed to send back the trial Court records forthwith along with a copy of this order to the trial Court.
