JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner has preferred this petition under Section 483 of the BNSS, 2023 praying to enlarge him on bail in Crime No.107/2025 of Soladevanahalli Police Station registered for the offence punishable under Section 137(2) of the BNS, 2023. 2. The learned Additional SPP submits that charge sheet has been filed in this case for offences under Section 137(2), 64(2)(m) of BNS, 2023 and Section 5(l) and 6 of the POCSO Act, 2012. 3. Learned counsel for the petitioner submits that, after filing of charge sheet, petitioner has not approached - 3 - HC-KAR NC: 2025:KHC:29952 CRL.P No. 8818 of 2025 the Sessions Court and therefore, he may be permitted to withdraw the petition with liberty to file a fresh petition before the Sessions Court. 4. In the order passed by the learned Sessions Judge, it is observed that in this case, investigation is not yet completed and such being the case, grant of bail to the petitioner may result in tampering the prosecution witnesses and therefore, no grounds are made out by the petitioner to grant bail. 5. In view of filing of charge sheet and considering the submissions of the learned counsel for petitioner, petition is dismissed as withdrawn, reserving liberty as sought for.
