The present writ petition has been filed challenging the First Information Report dated 04.03.2024 registering Case Crime No. 0003 of 2024, under Section 7 of Prevention of Corruption Act, 1988, Police Station Meerut - Sector (Vigilance Department), District Meerut. It has been argued by the counsel for the petitioner that from the recitals in the first information report itself, there is no evidence of any corrupt activity by the petitioner and the appointment even if erroneous cannot by itself be a cause to prosecute the petitioner under the Prevention of Corruption Act. The AGA representing respondent nos.1 to 3 has opposed the writ petition. After considering the rival submission of the parties and the facts of the case, the writ petition is disposed of with a direction that the petitioner shall not be arrested in pursuance to the First Information Report dated 04.03.2024 registering Case Crime No. 0003 of 2024, under Section 7 of Prevention of Corruption Act, 1988, Police Station Meerut - Sector (Vigilance Department), District Meerut till submission of police report under Section 173(2) Cr.P.C./ Section 193(3) B.N.S.S.
