JUSTICE RAVI V HOSMANI Digitally signed by ANUSHA V Location: High Court of Karnataka - 2 - HC-KAR NC: 2025:KHC:29764 WP No. 23000 of 2025 ORAL ORDER This writ petition is filed seeking for writ of mandamus directing respondent no.2 to consider petitioner’s application for revision of timings as per Annexure-D. 2. Sri M.E. Nagesh, learned counsel for petitioner submitted that petitioner was an existing stage carriage operator under Permit no.78/1996-97 valid upto 12.01.2027 for route from Shivamogga to Honnali and back (2 round trips), Shivamogga to Nyamati and back (1 round trip). It was submitted, since timings of route was inconvenient to travelling public, an application was filed for variation of condition of permit by way of curtailment of route as well as for revision in timings. In meeting of Regional Transport Authority ('RTA'), application with regard to curtailment of route was objected by KSRTC. Therefore, application only insofar as revision of timings was directed to be considered as per Annexure-A. Against order at Annexure-A, petitioner had filed appeal before State Transport Appellate Authority. Vide order dated 20.02.2018 at Annexure-B appeal was allowed and matter remitted back to RTA for reconsideration. - 3 - HC-KAR NC: 2025:KHC:29764 WP No. 23000 of 2025 3. During reconsideration, KSRTC submitted no objection for curtailment of route as well as for change of timings as per Annexure-C. Thus, there was no impediment for consideration of petitioner’s application. Petitioner had submitted representation on 11.07.2025 as per Annexure-D for consideration of his request for curtailment of route as well as for change of timings. Same had remained without consideration and therefore, sought for allowing writ petition by issuing necessary direction. 4. Smt.Vaheeda, learned Additional Government Advocate appearing for respondents, on advance notice, submitted if application filed by petitioner had remained without consideration, same would be considered within reasonable time. 5. Heard, learned counsel and perused writ petition record. 6. From above and since only relief sought is for direction to consider petitioner's representation at Annexure D and same apparently pending consideration, writ petition is disposed of directing respondents to consider petitioner's - 4 - HC-KAR NC: 2025:KHC:29764 WP No. 23000 of 2025 representation at Annexure-D within six weeks from date of receipt of certified copy of this order.
