Hon’ble Manoj Kumar Tiwari, J. (1) Mr. B. Koranga, Advocate holding brief of Mr Vikas Kumar Guglani, learned counsel for the petitioners. (2) Mr. S.S. Chauhan, learned Deputy Advocate General for the State of Uttarakhand. (3) Petitioners have approached this Court for protection. According to them, due to their inter-caste marriage, father and cousin of petitioner no. 1 are extending threat to them. (4) Both petitioners are personally present before the Court who are duly identified by their learned counsel Mr. B. Koranga. We have also interacted with them. (5) According to petitioner no. 2, he is working as Mason and he had studied upto 8th Standard. Petitioner No. 1 stated that she has passed High School Examination in the year 2021, however, she does not have High School Certificate at the moment. Both the petitioners stated that they are major and Aadhaar Card is enclosed as annexure no. 2, which indicates that date of birth of petitioner no. 1 is 11.09.2006. (6) Learned counsel for the petitioners stated that petitioners will get the marriage registered very soon. 2025:UHC:290-DB (7) Learned State Counsel submits that since both the petitioners are major and they are living together with their own free will, hence in view of the law laid down by Hon’ble Apex Court in the case of Lata Singh Vs. State of U.P. and Another; 2006 (5) SCC 475, he has no objection, if protection is granted to petitioners. (8) Accordingly, the present writ petition is disposed of with direction to the Station House Officer, P.S. Bazpur, District Udham Singh Nagar to provide protection to the petitioners for a period of six weeks and ensure that no harm is caused to them during this period. Upon expiry of six weeks, concerned SHO shall make assessment of threat perception to the petitioners, and provide protection to them, if needed, for such further period, as is felt necessary.
