The petitioner has preferred the present writ petition inter-alia with the following prayer:- "(1) To issue a writ, order or direction in the nature of certiorari to quash the order dated 28.12.2022 passed by respondent no. 2 in case no. P.W.11/2022 (Shri Ramji Pandey vs. Shri Satya Prakash Giri) as well as order dated 28/03/2025 passed by respondent no.2 in recall application 15/01/2024 moved by petitioner in case no. P.W. 11/2022 (Shri Ramji Pandey Vs. Shri Satya Prakash Giri). (Annexure No. 1 & 2 to the writ petition)" 2. Facts in brief as contained in the writ petition are that an application was filed by the Respondent No.3 namely Ramji Pandey before the Prescribed Authority under Payment of Wages Act, 1976 which was numbered as Case No.P.W.11 of 2022. The aforesaid application was allowed by the Prescribed Authority under Payment of Wages Act vide order dated 28.12.2022. 3. Aggrieved against the aforesaid, the recall application was filed by the petitioner which was rejected on 28.03.2025. Aggrieved against the aforesaid orders, the petitioner has preferred the present writ petition. 4. After some arguments, a prayer has been made by the counsel for the petitioner to dismiss the present writ petition as not pressed with liberty to the petitioner to file an appeal as provided under Section 17 of the Payment of Wages Act, 1936. 5. Prayer is allowed. 6. Accordingly, the writ petition is dismissed and not pressed with liberty as prayed.
