R/SCR.A/12811/2025 ORDER DATED: 09/10/2025 IN THE HIGH COURT OF GUJARAT AT AHMEDABAD R/SPECIAL CRIMINAL APPLICATION (HABEAS CORPUS) NO. 12811 of 2025 ========================================================== ASHISH GAJUBHAI ALABHAI MERIYA Versus STATE OF GUJARAT & ORS. ========================================================== Appearance: MR PUNIT B JUNEJA(3972) for the Applicant(s) No. 1 MS VRUNDA SHAH, ADDL PUBLIC PROSECUTOR for Respondent(s) No. 1 ========================================================== CORAM:HONOURABLE MR.JUSTICE N.S.SANJAY GOWDA and HONOURABLE MR.JUSTICE UTKARSH THAKORBHAI DESAI Date : 09/10/2025 ORAL ORDER (PER : HONOURABLE MR.JUSTICE N.S.SANJAY GOWDA) 1. This petition was filed seeking for a direction upon the respondents to produce Shri Gajubhai Alabhai Meria before the Court contending that he was in the illegal detention of the respondents. 2. Learned counsel for the petitioner submits that after the advance notice was served, an affidavit-in-reply was filed by the State. The corpus, in his affidavit, states that he was released in the night of 26th September 2025 and he came back home. In the affidavit, he does not state as to whether the police had detained him at any point of time and he says that he was detaimed by 4 to 5 persons whose faces were masked and whose identity he does not know. This affidavit would indicate that the corpus R/SCR.A/12811/2025 ORDER DATED: 09/10/2025 himself admits that he is not sure as to who had abducted him. Consequently, it cannot be held that the police had detained the corpus. 3. Be that as it may. Since the corpus has now returned and is not under the illegal confinement of anybody, no useful purpose would be served by entertaining this writ petition. The petition is, therefore, CLOSED. Notice is discharged. Sd/- (N.S.SANJAY GOWDA,J) Sd/- (UTKARSH THAKORBHAI DESAI, J) OMKAR Original copy of this order has been signed by the Hon'ble Judges.
