2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 24.07.2024 passed in Cr. Misc. No. 50139 of 2024.
3. The petitioner seeks regular bail in a case registered for the offence under Sections 376 and 511 of the Indian Penal Code and Section 4/6 of the POCSO Act.
4. The following order was passed on 24.07.2024 in Cr. Misc. No. 50139 2024:- Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner seeks bail in connection with Rupaspur P.S. Case No. 86 of 2024 registered for the offence punishable under Sections 376 and
Patna High Court CR. MISC. No.87471 of 2024(2) dt.08-01-2025 2/2 511 of the Indian Penal Code and Sections 4 and 6 of the POCSO Act.
3. The petitioner is said to have sexually assaulted the eight year old girl. The petitioner is in custody since 07.02.2024.
4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
5. Considering the serious nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the application stands dismissed.
5. All the charge-sheeted witnesses have been examined. In these circumstances, no ground for review of earlier order is made out.
6. Accordingly, this application for regular bail is again rejected.
