This is an appeal in terms of Section 21 of the National Investigation Agency Act, 2008 [“ the Act”] directed against an order dated 15th July, 2024, whereby the Court of Special Judge designated under NIA Act, Kulgam [“the Trial Court”] has rejected the bail applications of the appellants in challan FIR No. 53 of 2021 registered at Police Station Devsar. 2. On this appeal coming up for consideration, the learned counsel appearing for both the sides fairly submitted that the trial has reached its final stage and in that statement of only one prosecution witness is required to be recorded. 3. Having regard to the fact that the trial is at the final stage and only one prosecution witness is required to be recorded, we are of the considered opinion that this is not the right time for considering the bail plea of the appellants. However, having regard to the age of some of the appellants who are senior citizens, we are persuaded to request the Trial Court to wind up the entire trial as soon as possible, preferably within a period of two months. We also make it clear that in case for reasons given by the Trial Court it is not possible to conclude the trial within the two months, the Trial Court shall approach this Court for extension. 4.
