JUSTICE SUSMITA PHUKAN KHAUND ORDER Date : 28.03.2025 Heard learned counsel Mr. S.C Das for the petitioners Banjit Rajbongshi and Debabrata Mallick @ Debabrat Mallick who have filed this application under Section 483 of the BNSS, 2023 with prayer for bail as they are behind bars since 15.01.2025 in connection with Dispur PS Case No. 26/2025, under Section 103(1)/3(5) BNS. Heard Mr. D.P Goswami, learned Additional Public Prosecutor, Assam. The allegation against the petitioners is that they have killed the victim Akash Choudhury and pushed him in front of a water tanker which resulted in his death. I have scrutinized the case diary and have considered the submissions at the bar. It appears that bail may be granted to the petitioners. The merits of this case are not brought to the fore as investigation is still under progress. The petitioners are local residents and they have pledged to co-operate with the remaining part of the investigation. Considering all aspects, the petitioners are enlarged on bail of Rs 50,000/- each with a suitable surety of like amount to the satisfaction of the C.J.M, Kamrup(M). Send back the Case Diary.
