The petitioner has preferred instant writ petition for a direction upon the District Basic Education Officer, Jaunpur, to appoint him on compassionate ground on the post of Assistant Teacher in Junior Basic School, Awhadpur, Block Dhobi, District Jaunpur. Sri Tej Bhan Singh, learned counsel for the respondent BSA submits that claim of the petitioner has been rejected, thus, this writ petition has become infructuous. To the aforesaid submission, learned counsel for the petitioner prays to withdraw this writ petition with liberty to file a fresh writ petition challenging the claim rejection order. In view of the above, the writ petition is dismissed as having become infrucuous with the liberty as prayed for. No order as to costs.
