According to status report dated 27.09.2024, out of initially proposed 31 witnesses, now only 15 witnesses are proposed by the prosecution and 2 have already been examined. 3. Learned counsel for applicant has tried to give an impression that said two witnesses have not named applicant in their testimony, being a material contradiction from their statements recorded under Section 161 Cr.P.C., but as rightly pointed out by learned AGA that both witnesses are not eye witnesses as one is the witness who saw dead body for first time and informed police and other being son of deceased has identified present applicant and that in his presence on pointing out of present applicant, a phone belonged to deceased was recovered and he also informed police about involvement of other co accused. 4. Court finds that submission of learned counsel for applicant lacks fairness, accordingly, present bail application is hereby rejected.
