Instant writ petition under Article 226 of the Constitution of India has been preferred seeking following reliefs :- “10.1 That, this Hon'ble Court kindly be pleased to direct the respondent authority to consider the petitioner's candidature to promotion to the post of Assistant Grade-III/Lipik/Clerk. 10.2 To grant any other writ / writs, order / orders, relief / reliefs in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case, including awarding of the costs to the petitioner. 2. Learned counsel appearing for the petitioner submits that the petitioner was appointed on 28.12.2007 as Sweeper -cum- Watchman and was posted at Eklavya Model Residential School, Shiv Prasad Nagar (Bhaiyathan), District Surajpur (C.G.). His service was regularized by the Respondent - Department vide order dated 02.07.2010. Since then, the petitioner is working on the said post and he has not been granted further promotion to the post of Assistant Grade-III whereas as per applicable Rules, the petitioner is entitled to get promotion since 2012, therefore, it is prayed the respondent authorities may be directed to consider the issue of promotion of petitioner to the post of Assistant Grade-III. 3 3. Learned counsel for the State submits that the State has not filed reply till date, but he submits that relief sought for by the petitioner is only to direct the respondent authority to consider the petitioner’s candidature for promotion to the post of Assistant Grade-III/Lipik/Clerk. He further submits that respondents are ready to consider the petitioner’s case for promotion on the post of Assistant Grade-III, if appropriate direction is issued by this Court in this regard. 4. I have heard learned counsel for the parties and perused the material available on record. 5. Having considered the limited prayer made by the petitioner, no fruitful purpose would be served to keep pending instant petition. Hence, considering the limited prayer of the petitioner, this petition stands disposed of directing respondent authorities to consider case of the petitioner for his promotion to the post of Assistant Grade-III. The petitioner is also at liberty to file appropriate representation for redressal of his grievance within a period of thirty days from today, which shall be considered and decided by respondent authorities in accordance with law. 6. With the aforesaid observations & directions, the petition stands disposed of.
