Also heard Mr. D. P. Goswami, learned Additional Public Prosecutor for the State of Assam. 2. This is an application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioner Chan Mammud, has prayed for releasing him on bail after he was arrested in connection with Jagiroad Station Case No.249/2024. 3. The bail application of the petitioner was rejected by this Court earlier on the Page No.# 2/2 ground that he was found to a member of a gang, who commits highway robbery at night. 4. The petitioner has already completed 69 days in Judicial Custody. 5. Moreover, his wife is also suffering from certain medical conditions. 6. I have considered the submissions made by learned counsel for both the sides. 7. In spite of rejection of the earlier bail application, today this Court is of the opinion that keeping this petitioner in custody will not serve any purpose in the investigation of the Case. 8. Considering the length of detention, the bail application is allowed. 9. Accordingly, the petitioner Chan Mammud, who was arrested in connection with Jagiroad Station Case No.249/2024 shall be released on bail of Rs.25,000/- with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Morigaon. 10.
