Neutral Citation No. - 2025:AHC:40952 Court No. - 81 Case :- MATTERS UNDER ARTICLE 227 No. - 615 of 2025 Petitioner :- Vipin Kumar Respondent :- Basic Shiksha Adhikari Counsel for Petitioner :- Ajay Kumar Dwivedi Counsel for Respondent :- Suresh Kumar Maurya Hon'ble Ms. Nand Prabha Shukla,J. Heard Sri Ajay Kumar Dwivedi, learned counsel for the petitioner, Sri Suresh Kumar Maurya, learned counsel for the respondent, learned A.G.A. for the State and perused the record. By means of the present petition under Article 227 of the Constitution of India, the petitioner has prayed to set aside the impugned order dated 10.05.2024 passed by Chief Judicial Magistrate, Firozabad and revisional order dated 11.11.2024 passed by Additional Sessions Judge, Court No. 7, District- Firozabad. Briefly stated, the petitioner moved an application dated 18.12.2023 under Section 6(1) of the Right to Information Act requesting for obtaining information from the respondent/Basic Shiksha Adhikari, District-Firozabad after payment of the prescribed fee, but the said information was not furnished within thirty days. During the pendency of the said application, the petitioner filed an Appeal on 12.02.2024 under the Right to Information Act before the Assistant Director, (Basic Shiksha Agra Mandal, Agra. In the said appeal, the respondent/District Basic Shiksha Adhikari, Firozabad was directed to furnish the required information to the petitioner. Being aggrieved, the petitioner, pursuant to Sections 166 and 167 IPC moved an application under Section 156(3) Cr.P.C. for lodging of an FIR but the same was rejected by the Chief Judicial Magistrate, Firozabad vide order dated 10.05.2024 on certain grounds. The main submission of learned counsel for the petitioner is that the respondent being the public authority was supposed to furnish the information as sought under Section 6 of the Right to Information Act. Further, it was argued that the amount of fee paid through postal order was embezzled and was not deposited in the Government Fund. Thus, in the light of the judgment given in Lalita Kumari vs State of U.P. AIR (2014) SC 187, the offence being cognizable in nature, therefore, the FIR was to be registered. From the perusal of records, it transpires that during the pendency of the application under Section 156(3) Cr.P.C., a report was forwarded by the City Magistrate, Firozabad. The contents of the report dated 10.05.2024 forwarded by City Magistrate, Firozabad are as under: "जजिलला बबेजसिक शशिकला अजधिकलाररी शफिररोजिलाबलाद दलारला कजथित शकयला गयला शक पलाथिर्थी शविपन कक मलार उपररोक्त दलारला जिन सिसूचनला अजधिकलार अजधिशनयम 2005 कबे तहत सिसूचनला उपलब्धि करलायबे जिलानबे हबेतक पलाथिरनलापत्र पस्तकत शकयला गयला जिरो कलायलारलय ररसिरीवि रजजिस्टर कबे क्रम सिसंख्यला - 11653 पर असंशकत कर शरी पसंकजि कक मलार शचमनलानरी एम०आई०एसि० इन्चलाजिर /पसूविर जिन सिसूचनला पटल सिहलायक कबे दलारला पलाप्त शकयला गयला। From the bare reading of the aforesaid report, it indicates that the requisite information was provided to the petitioner and the amount of the fee paid through postal order was also deposited through Accounts Head-0070-60-800-11 vide Challan No. DA03037 dated 10.04.2024, therefore, no such Government Fund was embezzled. It is also true that the appellant has a remedy to file an appeal under Section 19(1) of the Right to Information Act and again a second appeal under Section 19(3)(1) of the Right to Information Act, therefore, there is no occasion to lodge an FIR by filing an application under Section 156(3) Cr.P.C. Even the revision filed by the petitioner against the order dated 10.05.2024 passed by learned Chief Judicial Magistrate, Firozabad has been dismissed on 11.11.2024 by Additional Sessions Judge, Court No. 4, Firozabad by a detailed and reasoned order. Considering the aforesaid facts and circumstances, there is no ground to interfere in the matter. Accordingly, the petition is dismissed. However, the petitioner can seek appropriate remedy before the authority concerned by filing an appeal or second appeal as provided under Sections 19 and 19(3) of the Right to Information Act.
