The Criminal Petition, u/Sec.480 & 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is filed on behalf of the petitioner/A11 to grant regular bail in connection with Crime No.79/2024 of Anantagiri Police Station, ASR District. 2. A case has been registered against the petitioner herein and others for the offences punishable u/Sec.111(2)(b) of B.N.S and Section 20(b)(ii)(C), 25 r/w 8(c) of NDPS Act. 2
3. The case of the prosecution in nut shell is as follows:
On 22.11.2024 at 6.00 pm, on receipt of credible information about illegal possession and transportation of ganja, the Sub-Inspector of Police, along with staff and mediators and conducted vehicle checking infront of Ananthagiri police station. They found two swift cars coming towards them and when police tried to stop the cars, the inmates in the cars did not stop the car and the inmates stopped the cars at some distance and they tried to escape. Then police apprehended six persons and on enquiry, they disclosed their identity particulars and police found 100 kgs of ganja in their possession. They were arrested, seized the contraband and vehicles and produced them before the Court for judicial remand. Basing on their confession, the name of the petitioner was added in the F.I.R and the petitioner was arrested on 22.11.2024. 4. Heard Sri K.Joji Amrutha Raju, learned counsel for the petitioners and Sri Neelothpal Ganji, learned Assistant Public Prosecutor for the respondent. 5. Learned counsel for the petitioner would submit that nothing has been seized from the possession of the petitioner and by this time, most of the investigation pertaining to the role played by the petitioner might have been completed and the petitioner is ready to furnish solvent sureties to the satisfaction of the Court and prays to allow the criminal petition. 3

Contra to the same, learned Assistant Public Prosecutor vehemently opposed the petition stating that inventory is pending in this matter and the seized contraband is a commercial quantity and prays to dismiss the criminal petition. He further submitted that there are two more cases pending against the petitioner and it is an organized crime. 7. Considering the submissions made and on perusal of the material on record shows that, the contraband seized in this case is 100 kgs and the statutory period was not over. Though the contraband is not seized from the possession of the petitioner, but as stated by the learned Assistant Public Prosecutor that this is an organized crime and the contraband involved is commercial quantity and as the investigation is not completed, this Court is not inclined to grant bail to the petitioners at this stage. 8. In the result, the criminal petition is dismissed. Consequently, miscellaneous applications pending, if any, shall stand closed. _____________________________________
