S DIHINGIA, MS. K DAS,MR I HASSAN,MR. R P SARMAH Advocate for the Respondent : SC, FOREST, GA ASSAM BEFORE HONOURABLE MR. JUSTICE MICHAEL ZOTHANKHUMA ORDER 30.04.2025 Heard Mr. R.P. Sharmah, learned Senior Counsel assisted by Mr. S. Dihingia, learned counsel for the petitioner. Also heard Mr. D. Gogoi, learned counsel, Forest Department for the respondents. The counsels for the parties submit that a fresh NIT would have to be issued for settlement of Dilli River Stone Mining Area “A” (VB) (Stone), in view of the Page No.# 3/3 fact that the settlement of the mining area with the respondent no.8 is to expire on 18.06.2025, as the schedule for depositing the last kist was 19.03.2025. The learned counsels for the parties thus submit that the writ petition has become infructuous and the State respondents should issue a fresh NIT, if the respondents decide to lease out Dilli River Stone Mining Area “A” (VB) (Stone) mining area for mining purposes beyond 18.06.2025. In view of the consent of the parties, the writ petition is closed as infructuous. The respondents shall accordingly take a decision as to whether they want to lease out Dilli River Stone Mining Area “A” (VB) (Stone) for mining purposes after the expiry of the present period of settlement and take action accordingly.
