GP FOR FINANCE PLANNING 2 THE HON’BLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION No.5398 OF 2025 ORDER: The Writ Petition is filed questioning inaction of the respondents in withholding an amount of Rs.4,35,546/- even after finalizing the bills payable to the Petitioner in relation to work i.e., “providing CC Road from Pole No.17/31-F to Varun RO Plant near Chowdamma Temple front side in Ramapuram, Ward No.18 in Rayachoty Municipality vide Agreement No.536/2023-2024, dated 11.12.2023”. 2. When the matter is came up for hearing, the learned Standing Counsel passed on written instructions received by him, signed by the Commissioner, Rayachoty Municipality, wherein paragraph No.4 reveals that the Petitioner had executed the work as stipulated under agreement referred above. It is further submitted that the payment could not be made due to lack of funds and the financial status of the Respondent-Municipality is not in good position to pay the amounts from the Municipal General Funds. It was stated that the Municipality will be paying the amounts as and when the amounts are released under GGMP- HIW Grant, without any delay. 3 3. In view of the aforesaid submissions and also considering the fact that there is no dispute with regard to the execution of work and the amounts due to the Petitioner, this Court is inclined to dispose of the Writ Petition with following direction: (i) The Respondent-Corporation is directed to pay the amounts due to the Petitioner within a period of four (04) months from the date of receipt of the copy of this order.
