01. For a purported claim relatable to execution of work/s which are said to have been carried out by the petitioner as a contractor concern in terms of NIT No. 09/JKTDC of 2014 dated 24.10.2014 followed by issuance of Letter of Intent No. JKTDC/EE/M&W/03 dated 04.12.2014 read with supplementary agreement/s which do not bear any reference number or date, for execution of work valuing Rs. 7.95 lacs + additional amount, the petitioner is coming forward in August, 2025 with the present writ petition bearing a prayer that it has
a claim of an admitted liability of Rs. 15.00 lacs payable in its favour from the respondents’ end for work executed by the petitioner.
02. The writ petition is supported by only two documents as annexures, both are of 2015-16 time line.
03. Ex-facie, the writ petition deserves to be dismissed on account of delay and laches attending the petitioner in coming to this court despite being fully cognizant of the fact that it was having a purported claim against the writ respondents in the matter of payment of the work done liability.
04. The
learned counsel for the petitioner submits that there are certain documents/ correspondence/communications involving the petitioner and the respondents, which would afford the petitioner a cause of action to come up with a writ petition at this point of time but since so-called documents/correspondence/communications have not been pleaded in and placed on record of this writ petition, as such, the learned counsel for the petitioner seeks withdrawal of the writ petition with a liberty to file a fresh one bearing proper factual
narrative and documents/correspondence/ communications in support thereof.
05. In the interest of justice, this court dismisses this writ petition with liberty granted granted subject to the condition that the writ petition as may come to be filed pursuant to the liberty shall be accompanied with a certified copy of this writ petition as well as this order disposing of this writ petition.
