Accused No.10 in S.C.No.897/2025 pending before the Court of 64th Additional City Civil and Sessions Judge (CCH-65), Bengaluru arising out of Crime No.218/2023 registered by Yelahanka New Town Police Station, Bangalore for the offences punishable under Sections 363, 364-A, 504, 506, 323, 105 read with Section 34 of Indian Penal Code and Section 25(1) of Arms Act, is before this Court under Section 483 of BNSS 2023 seeking regular bail.
2. Heard the learned counsel for the parties.

Learned counsel for the petitioner submits that on the merits of the case, the petitioner was earlier granted anticipatory bail in the present case by jurisdictional Sessions Court in Crl.Misc.No.8765/2023 disposed of on 13.09.2023. For the reason that the petitioner had not appeared before the Court, his presence was secured and he was remanded to judicial custody. The case against the petitioner is now committed to the jurisdictional Sessions Court and is numbered

in S.C. No.897/2025 on the file of 64th Additional City Civil and Sessions Judge (CCH-65), Bengaluru. In the earlier criminal cases which were registered against the petitioner for the offences punishable under Sections 420, 468 etc., he has been enlarged on bail. Accordingly, he prays to allow the petition. 4. Per contra, the learned HCGP who has opposed the bail petition submits that the petitioner is a person who is having criminal antecedents and in the event he is enlarged on bail, it would be difficult to secure his presence. Hence prays to dismiss the petition. 5. Perusal of the material on record would go to show that the petitioner's name is found in the FIR registered in the present case. FIR was registered against one Manoj alias Kencha and others based on the first information received on 16.07.2023 from Smt.Vasundara. Apprehending arrest, the petitioner had filed Crl.Misc.No.8765/2023 before the jurisdictional Sessions Court which was allowed on 13.09.2023. Learned Sessions Judge while granting anticipatory bail to the petitioner in Crl. Misc. No.8765/2023 had observed that the name of the petitioner is not found in the FIR or in the remand

application. The allegation against the petitioner is that he had instigated the other accused to commit the crime and the name of the petitioner was not disclosed by accused Nos.1 and 3 after they were arrested. It appears that the petitioner who was granted anticipatory bail in Crl.Misc.No.8765/2023 had failed to appear before the committal Court on all dates of hearing and therefore, his presence was secured on 19.04.2025 and on the said date, he was remanded to custody. 6. Submission made by the learned counsel for the petitioner that in the earlier cases, he has been granted bail is not seriously disputed by the learned HCGP.
Insofar as the present case is concerned, petitioner who was granted anticipatory bail on 13.09.2023, has been now remanded to the judicial custody for the reason that he had not appeared before the Court on regular dates of hearing. The apprehension expressed by the learned HCGP can be taken care of by this Court by imposing stringent conditions. Accordingly, the following:-
ORDER The criminal petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.218/2023 registered by

Yelahanka New Town Police Station, Bangalore for the offence punishable under Sections 363, 364-A, 504, 506, 323 read with Section 34 of Indian Penal Code and Section 25(1) of Arms Act, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner is directed to appear before the S.H.O of Yelahanka New Town Police Station on every 1st Sunday of the month between 10.00 am and 1.00 p.m. and mark his attendance for a period of one year. d) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; e) The petitioner shall not involve in similar offences in future.
