JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is accused No.1 in Cr.No.373/2024 of Govindapura Police Station, pending before the learned XXVIII Additional City Civil and Sessions Judge, Mayohall, Bengaluru, registered for the offence punishable under Section 309(6) of BNS, 2023. 2. FIR was registered against two unknown persons, on a complaint lodged by the victim by name Sri.Hasanasab Nadaf, wherein, he has stated that he is working as a zepto delivery agent. On 29.10.2024 at about 10.30 p.m., while he was going to deliver an order to a customer in HBR Layout, Bangalore, two unknown persons on a Dio bike, bearing Reg.No.KA-03-KL-6126 - 3 - HC-KAR NC: 2025:KHC:35996 CRL.P No. 11491 of 2025 approached him and forcefully snatched his mobile phone and cash of Rs.5,000/-. They asked his account UPI PIN number and assaulted him on his head with a knife. 3. In the course of investigation, accused Nos.1 and 2 were arrested. The mobile phone of the victim, a chopper and the scooter were recovered from them. The petitioner was arrested on 01.11.2024. He is in custody. From the material placed on record, there is a prima-facie case against the petitioner. Moreover, it is submitted by the learned High Court Government Pleader that petitioner is an habitual offender, involved in other criminal cases and in one of the cases, he is absconding and therefore, the said case against him has been split-up. 4. The accused Nos.1 and 2 have not only robbed the victim, but stabbed on his head and caused injury to him. Petitioner is involved in other criminal cases. Considering the facts and circumstances, this Court is of - 4 - HC-KAR NC: 2025:KHC:35996 CRL.P No. 11491 of 2025 the considered view that this is not a fit case to enlarge the petitioner on bail.
