HON'BLE SRI JUSTICE K.SURESH REDDY CRIMINAL PETITION No. 2121 OF 2025 ORDER: As per the directions of My Lord the Hon'ble the Chief Justice, this criminal petition has been allotted to this Bench by notice dated 25-03-2025 and the same is treated as part of the roster effective from 26-03-2025. 2. This criminal petition, under Section 482 of Bharatiya Nagarik Suraksha Sanhita, is filed by the petitioners-accused Nos. 1 to 4 seeking to release them on bail in the event of arrest in crime No. 7 of 2024 of Badvel (U) Police Statiion, Kadapa District. The said crime was registered initially for the offences punishable under Sections 333 and 118 (1) read with Section 3 (5) of Bharatiya Nyaya Sanhita. Subsequently, Section 118 (1) is altered to Section 118 (2) of Bharatiya Nyaya Sanhita. 3. Heard Sri Shaik Mohammed Ismail, learned counsel appearing for the petitioners-accused Nos. 1 to 4, and learned Additional Public Prosecutor appearing for the respondent-State. 4. Case of the prosecution is that on 06-01-2025 at about 6.30 p.m. while de facto complainant along with his relatives was 2 watching television, the petitioners-accused Nos. 1 to 4 armed with sticks came there and beat de facto complainant and his relatives who received injuries. Subsequently, they went to Government General Hospital, Badvel, and obtained first aid and thereafter, they were referred to RIMS Hospital, Kadapa. On the next day, de facto complainant went to police station and gave a report to police, on the basis of which the present crime has been registered. 5. Learned counsel appearing for the petitioners-accused Nos. 1 to 4 contends that the petitioners also gave a report to police against de facto complainant and others alleging that de facto complainant and his members beat them and that on the basis of the said report, a case in crime No. 8 of 2025 of same police station has been registered. He therefore requests this Court to grant anticipatory bail to the petitioners-accused Nos. 1 to 4. 6. In view of the above facts and circumstances, as they are case and counter case in nature and as the petitioners are closely related to the prosecution party, this Court is inclined to grant anticipatory bail to the petitioners-accused Nos. 1 to 4. 3 7. The petitioners-accused Nos. 1 to 4 are, therefore, directed to surrender before the Station House Officer, Badvel (U) Police Station, Kadapa District, on or before 17-04-2025. On such surrender, the petitioners-accused Nos. 1 to 4 are ordered to be enlarged on bail on their executing each a personal bond for Rs.10,000/- with two sureties for the like sum each to the satisfaction of the Station House Officer, Badvel (U) Police Station. After release, the petitioners-accused Nos. 1 to 4 are directed to report before the Station House Officer, Badvel (U) Police Station, once in a week i.e. on every Monday between 10 a.m. and 1 p.m. until further orders. 8.
