THIS PETITION, COMING ON FOR PRELIMINARY HEARING IN ‘B’ GROUP, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD ORAL ORDER 1. In this writ petition, the petitioner has sought for the following relief/s: “a) Issue writ by way of mandamus, direction or order directing the Respodnents to settle the pensionary benefits of Late B.Annadanappa along with interest at 18% per annum from the day it became due and till the date of payment in pursuance to the representation of the Petitioner - 3 - HC-KAR NC: 2025:KHC:32412 WP No. 10799 of 2022 dated:30.06.2020 vide Annexure ‘H’ and reply of the 1st Respondent dated: 18.01.2021 vide Annexure ‘J’. b) Issue any order of writ as this Hon’ble Court deems fit in the circumstances of the case including an order for compensatory costs of this petition to be paid by the Respondents for their delay and latches in discharging their duties, in the interest of justice and equity.” 2. The case of the petitioner is that her father, Late Sri B. Annadanappa, was working as an Assistant Executive Engineer in the Irrigation Department. He retired from service on attaining superannuation on 31.07.1997 and at that time, he was working in the Krishna Bhagya Jala Nigama Limited, Indi Branch Channel, Sub-Division No.22, Golagere. After his retirement, his pensionary benefits and arrears of salary were not settled by the Department. Consequently, the petitioner’s father submitted representations, as per Annexures-A and B. Thereafter, he passed away on 29.03.2002. - 4 - HC-KAR NC: 2025:KHC:32412 WP No. 10799 of 2022 The petitioner’s mother, Smt.Nirmala, later submitted a representation (Annexure-E) seeking disbursement of the claims stated in her letter dated 02.12.2004. She also died on 07.03.2016. The petitioner, being the adopted daughter of Late Sri Annadanappa, submitted a representation (Annexure-H) dated 30.06.2020, seeking the service benefits, pension benefits, and arrears of salary due to her father. However, till date, no action has been taken by the respondent. Hence, the present petition has been filed. 3. The learned Additional Government Advocate (AGA) appearing for the respondents submitted that if this Court grants some reasonable time, the representation submitted by the petitioner (Annexure-H) will be considered in accordance with law. 4. In view of the above, without expressing any opinion on the merits of the case, the writ petition is disposed of. - 5 - HC-KAR NC: 2025:KHC:32412 WP No. 10799 of 2022 Respondent No.3 is directed to consider the petitioner’s representation dated 30.06.2020 (Annexure- H) in accordance with law, as expeditiously as possible, and in any case not later than three months from the date of receipt of a certified copy of this order.
