JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 6 13-05-2025 Heard learned counsel for the petitioners and the State. 2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 341, 323, 307, 504, 506/34 of the Indian Penal Code. 3. As per the prosecution case, dispute arose over opening of a window by the petitioners side towards the house of the informant in which it is alleged that petitioner no.3 assaulted with iron rod on the head of Mantun Kumar causing him grievous injury on the head. Petitioners no.2 are alleged to have assaulted wife of informant with lathi causing her simple injuries. 4. Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. petitioner no.3 and informant are full brothers. There is case and counter case in which both sides Patna High Court CR. MISC. No.87694 of 2024(6) dt.13-05-2025 2/2 sustained injuries. Petitioners claim clean antecedent. 5. Considering the fact that petitioner no.3 caused grievous injury to son-in-law of the informant, prayer for bail of petitioner no.3 is rejected. 6. Considering the fact that petitioners no.1 and 2 caused simple injury to the wife of informant, prayer for bail of thes petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioners no. 1 and 2, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in Alauli Police Station Case No. 219 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
