Mr. Sandeep Kothari, Advocate for the petitioner. 2. Mr. Narain Dutt, Standing Counsel for the State of Uttarakhand. 3. Petitioner is serving as Assistant Teacher, L.T. Grade (Hindi) in Government Girls Inter College, Narendra Nagar, Tehri Garhwal. She was transferred to Government Girls Higher Secondary School, Dharkot, Kirtinagar, District Tehri Garhwal, vide order dated 26.06.2023. Feeling aggrieved by her transfer, petitioner filed this writ petition. 4. Learned counsel for the petitioner contended that petitioner is suffering from heart ailment and angioplasty was done on her in the year 2021, therefore, she is exempted from compulsory transfer as per the Transfer Act, therefore, the impugned order is unsustainable. 5. Per contra, learned State Counsel submits that since petitioner had served at sugam places for more than seventeen years, therefore, as per the provisions of Transfer Act, she was liable for transfer to a durgam place, and accordingly, the impugned transfer order was passed. He further submits that one Ms. Vimla Bisht was transferred in place of the petitioner at Government Girls Inter College, Narendra Nagar, District Tehri Garhwal and perhaps Ms. Vimla Bisht has joined. 2025:UHC:8594 6. A coordinate Bench, vide order dated 07.07.2023, had passed an interim order, staying the effect and operation of the impugned transfer qua the petitioner and more than two years have gone by since passing of the interim order, therefore, no useful purpose would be served by keeping this writ petition pending. 7. Accordingly, the writ petition is disposed of by permitting petitioner to make representation to the competent authority for re-considering the transfer order passed against her. If petitioner makes such representation within ten days from today, the competent authority shall take decision thereupon, as per law, within two months thereafter. 8. For a period of ten weeks, the status quo as regards petitioner’s posting shall be maintained.
