Respondent ORDER On the last hearing date, i.e. 21.12.2024, the respondent/defendant had appeared as a party in person even though he was already set exparte by this Court in the Interlocutory Applications on 11.11.2024. The respondent/defendant submitted to this Court on 21.12.2024 that he is willing to change the name of the respondent/defendant, provided if sufficient time is granted. He also submitted that he will furnish a letter in writing to the applicants' counsel with regard to his proposal for settlement on 21.12.2024 itself. The undertaking given by the respondent/defendant, who had appeared as party in person, was recorded by this Court in its earlier order dated 21.12.2024. 1/2 https://www.mhc.tn.gov.in/judis ABDUL QUDDHOSE,J. vga 2.Today, there is no representation on the side of the respondent/defendant. 3.Learned counsel for the applicants/plaintiffs submits that till date, the respondent/defendant has not furnished the letter of undertaking as agreed upon by him, which was recorded in this Court's earlier order dated 21.12.2024. 4.The applicants/plaintiffs are having the benefit of interim injunction in O.A. Nos.707 & 708 of 2024 from 27.11.2024 onwards. Since there is no representation on the side of the respondent/defendant and since the applicants/ plaintiffs have made out a prima facie case and have established balance of convenience and irreparable hardship as observed in this Court's earlier order dated 27.11.2024, this Court is making the interim injunction order dated 27.11.2024 granted in favour of the applicants/plaintiffs in O.A. Nos.707 & 708 of 2024 absolute. Accordingly, O.A. Nos.707 & 708 of 2024 are allowed as prayed for. 5.A.No.5075 of 2024, which has been filed by the applicants/plaintiffs seeking to combine the cause of action, is allowed as prayed for since sufficient cause has been shown by the applicants/plaintiffs for the said relief.
