3. The applicant – Ajay, who is in judicial custody in connection with FIR/Case Crime No. 129 of 2023, under Section 302 of IPC, registered at P.S.- Shyampur, District Haridwar, has sought his release on bail.
4. Heard learned counsel for the parties and perused the records.
5. Learned counsel for the applicant submits that the applicant was not named in the FIR; that the applicant has been falsely implicated in the case; that no other incriminating evidence was found and that he has been languishing in jail since 15.11.2023.
6. Per contra, learned State Counsel submits that the accused is husband of the deceased. Despite the fact that deceased was missing since 08.11.2023, no missing report was lodged. Furthermore, the applicant has been arrested on the basis of last seen evidence as per the CCTV footage.
7. Having considered the facts and circumstances of the case, this Court is of
the view that there is no good ground to enlarge the applicant on bail and the present bail application deserves to be rejected.
8. The present bail application is rejected.
