Neutral Citation No. - 2025:AHC:10967-DB Court No. - 40 Case :- WRIT - C No. - 26992 of 2024 Petitioner :- Ajay Kumar Respondent :- Union Of India And 4 Others Counsel for Petitioner :- Siddharth Singh Counsel for Respondent :- A.S.G.I.,Anand Tiwari,C.S.C.,Manoj Kumar Singh Hon'ble Shekhar B. Saraf,J. Hon'ble Vipin Chandra Dixit,J.
1. Heard learned counsel appearing on behalf of the petitioner, Sri Manoj Kumar Singh, learned counsel appearing on behalf of the respondent No.1 and Sri Anand Tiwari, learned counsel appearing on behalf of the respondent Nos.2 & 3.
2. This is a writ petition under Article 226 of the Constitution of India wherein the writ petitioner is aggrieved by the alleged issuance of 'Letter of Intent' in favour of the respondent No.5.
3. Upon perusal of the documents on record, it appears that the petitioner was never selected in the draw of lots in the year 2018. Respondent No.5 was selected in the said draw, however, 'No Objection Certificate' was not issued by the Public Works Department, and accordingly, the respondent Corporation allowed the respondent No.5 to provide the alternative suitable land in terms of the Guidelines for Resitement of Retail Outlet Dealerships. From the aforesaid, it is clear that the petitioner has no locus standi to file the present petition as he was never selected. Furthermore, the argument raised by the counsel appearing on behalf of the petitioner that the respondent No.5 provided a land that was completely unsuitable is not tenable as the land was suitable as per the respondent Corporation but could not be accepted because of lack of 'No Objection Certificate' issued by the Public Works Department.
4. We do not find any infirmity in the action of the respondent Corporation. In light of the same, the writ petition is dismissed.
5. There shall be no order as to costs. Order Date :- 22.1.2025 Kuldeep (Vipin Chandra Dixit, J.) (Shekhar B. Saraf, J.) Digitally signed by :- KULDEEP SINGH High Court of Judicature at Allahabad
