(Oral) The applicant seeks anticipatory bail in FIR/Case Crime No.49 of 2023, dated 03.02.2023, under Sections 120-B, 409, 420, 467, 468, 471 IPC, Police Station Kotwali Dehradun, District Dehradun. 2. Heard learned counsel for the parties and perused the record. 3. According to the FIR, the applicant was Assistant Branch Manager in the District Co-operative Bank Limited, Branch Clock Tower, Dehradun. During his tenure loans were disbursed to many persons, but there were great irregularities and misappropriation. 4. Learned counsel for the applicant would submit that many co-accused have been granted anticipatory bail and bail; the applicant was the Assistant Branch Manager; he did not misappropriate any money; in the departmental inquiry also, he has not been blamed for any misappropriation; some irregularities have been indicated against him. 2 5. Learned State Counsel submits that it was found that while disbursing loans, the applicant did not follow the norms; he did not ensure that formalities are completed as per the Rules and Regulations. He submits that the applicant persuaded the persons to take loans from the District Co-operative Bank and he has disbursed the loan without following norms. 6. Essentially, what is stated is that the applicant has committed irregularities and not followed the norms, as such in terms of documents, etc. while disbursing loan. 7. Having considered, this Court is of the view that this is a case, in which, the applicant should be granted anticipatory bail. The instant anticipatory bail application deserves to be allowed. 8. The anticipatory bail application is allowed. 9. In the eventuality of arrest, the applicant shall be enlarged on bail on his furnishing a personal bond with two sureties, each in the like amount, to the satisfaction of the court concerned. In addition to it, the applicant shall also comply with the following conditions:- (i) The applicant shall not approach any witness in any manner, whatsoever. (ii) The applicant shall not leave the country without prior permission of the concerned court. (iii) The applicant shall deposit his passport with the court concerned. The passport may only be returned by the order of the court concerned. If the applicant does not 3 have passport, he shall give an undertaking to that effect to the court concerned. (v) The applicant shall also give an undertaking on (i) & (ii) above.
