ORAL COMMON ORDER
Both the petitions arise out of Cr.No.113/2025 of Masti Police Station, Kolar, registered for the offence punishable under Section 3 and 4 of Dowry Prohibition Act, 1961 and Section 352, 118(1), 115(2), 351(2), 89, 49 and 85 of BNS, 2023. Hence, taken up together and disposed of by this common order.
2. Heard both sides and perused the material on record.
3. Petitioner in Crl.P.No.12270/2025 is accused No.2 and petitioner in Crl.P.No.12271/2025 is accused No.1.
4. FIR is registered against accused Nos.1 to 4, on a complaint lodged by Smt.Sumashree, wife of accused No.1. She has alleged that her marriage with accused No.1 took place 20.5.2020. At the time of marriage, her

mother-in-law and her husband demanded dowry and therefore, one golden neck chain weighing 20 gms., one ring weighing 10 gms. and cash of Rs.1,00,000/- was given to accused No.1. She was given a gold necklance weighing 35 grams and ear rings weighing 20 grams and two rings weighing 20 grams and 5 grams each. It is alleged that for about one year, she was looked after well and when she was pregnant, at the instigation of accused Nos.3 and 4, she was subjected to torture and harassment by her husband to bring additional dowry etc. It is further alleged that, once again, when she was three months pregnant, accused forcibly administered some tablets and got her pregnancy terminated, and they abused and assaulted her etc.

Learned counsel for petitioner contended that on 2.7.2025, accused No.1 lodged a complaint with the police pertaining to the dispute between the couple and the police registered NCR No.202/2025. A copy of the NCR has been enclosed. It shows that panchayats were

held by the elders on 1.7.2025 at about 8.00 p.m. to solve the dispute between the couple. Thereafter, the complainant went to her parental house and refused to join her husband.
6. The instant case is registered on 9.7.2025 against accused Nos.1 to 4. While filing the chargesheet, Section 89 and 49 are deleted. Further, names of accused Nos.3 and 4 are also dropped from the chargesheet.
7. It appears that there is a serious matrimonial dispute between the couple. Accused No.1 was arrested on 9.7.2025 and he is in judicial custody. Accused No.2 is the mother of accused No.1. She is seeking anticipatory bail.
8. In the facts and circumstances, the relief sought in both the petitions can be granted by imposing necessary conditions. Hence, the following:

ORDER I. Crl.P.No.12270/2025 is allowed. II. Petitioner/accused No.2 in Crime No.113/2025 registered by Masti Police Station, Kolar, is ordered to be released in the event of her arrest, subject to following conditions: a) She shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with a surety for the likesum. b) She shall furnish her residential address/contact number and shall inform the I.O. in case of change in the address/contact number. c) She shall co-operate with the investigation of the case. d) She shall not tamper with the prosecution evidence/witnesses either directly or indirectly.

e) She shall be regular in attending the Court proceedings.
III. Crl.P.No.12271/2025 is allowed. IV. Petitioner/accused No.1 in Crime No.113/2025 of Masti Police Station, Kolar, shall be enlarged on bail, subject to following conditions: a. He shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only), with a surety for the likesum to the satisfaction of the jurisdictional Court. b. He shall furnish proof of his residential address and shall inform the Court, if there is change in the address. c. He shall not directly or indirectly tamper with the prosecution witnesses. d. He shall not indulge himself in committing any offence. e. He shall appear before the trial Court regularly on all dates of hearing.
