APARESH KUMAR SINGH Order 21/05/2025 The order dated 30.06.2023 by which the bail bond was forfeited under Section 446 of the Cr.P.C. has not been challenged. By the impugned order dated 24.02.2025, the Officer In-charge, Sonamura P/S has been directed to realize the forfeited bail bond amount of Rs.1,00,000/- from the petitioner who was surety for the accused Gopal Sarkar @ Suman under Section 421(a) of Cr.P.C. Mr. Anjan Kanti Pal, learned counsel for the petitioner, seeks time to lay challenge to the main order of forfeiture of the bail bond. Mr. Rajib Saha, learned Additional Public Prosecutor, for the respondent-State, points out that the order of forfeiture of bail bond is appealable under Section 449 of the Cr.P.C. Mr. Anjan Kanti Pal, learned counsel for the petitioner, submits that earlier an appeal was filed against the impugned order. However, if the Court permits, he may be allowed to convert this petition into an appeal. Accordingly, Mr. Anjan Kanti Pal, learned counsel for the petitioner, is at liberty to do so. Let such correction be also made within a period one week. List the matter thereafter before the appropriate Bench.
