Neutral Citation No. - 2025:AHC:142240 Court No. - 52 Case :- WRIT - A No. - 11946 of 2025 Petitioner :- Sanjiv Kumar Singh Respondent :- State Of U.P And 3 Others Counsel for Petitioner :- Rohit Upadhyay Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J.
1. Heard Mr. Nitinjay Pandey, Advocate, holding brief of Mr. Rohit Upadhyay,
learned counsel for the petitioner and Mr. Hare Ram, learned counsel for the State.
2. The writ petition has been filed seeking direction to District Basic Education Officer, Auraiya to consider the claim of the petitioner for appointing her on the post of 'Shiksha Mitra' as per the resolution of Gram Shiksha Samiti, Vadepur Gramin, Block-Achalda, District- Auraiya.
3. Mr. Hare Ram, learned standing counsel, points out that the issue regarding appointment of Shiksha Mitra has already been settled in the bunch of petitions as decided on 13.02.2024 leading one being Writ A No.15229 of 2019, in which, the petitioner had also filed Writ A No.15862 of 2019, which was dismissed by the co- ordinate bench of this Court and the Special Appeal No.274 of 2024 against the aforesaid order has also been dismissed. Therefore, the petitioner is not entitled for the appointment on the post of Shiksha Mitra.
4. This Court finds that once it has already been held by this Court in Writ A No.15862 of 2019 that the appointment of the petitioner was void, therefore, the resolution passed by the Gram Shiksha Samiti, ignoring the orders of the Court, is bad in the eyes of law, hence, the prayer as made in the present writ petition is misconceived.
5. In view of the above, the writ petition lacks merit and accordingly stands dismissed.
