Neutral Citation No. - 2025:AHC:142124 Court No. - 52 Case :- WRIT - A No. - 11955 of 2025 Petitioner :- Kavita Yadav Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Rohit Upadhyay Counsel for Respondent :- C.S.C. Hon'ble Mrs. Manju Rani Chauhan,J. 1. Heard Mr. Nitinjay Pandey, Advocate, holding brief of Mr. Rohit Upadhyay, learned counsel for the petitioner and Mr. Hare Ram, learned counsel for the State. 2. The writ petition has been filed seeking direction to District Basic Education Officer, Firozabad to consider the claim of the petitioner for appointing her on the post of 'Shiksha Mitra' as per the resolution of Gram Shiksha Samiti, Kuri Kupa, Firozabad. 3. Mr. Hare Ram, learned standing counsel, points out that the issue regarding appointment of Shiksha Mitra has already been settled in the bunch of petitions as decided on 13.02.2024 leading one being Writ A No.15229 of 2019, in which, the petitioner had also filed Writ A No.14436 of 2019, which was dismissed by the co- ordinate bench of this Court and the Special Appeal No.274 of 2024 against the aforesaid order has also been dismissed. Therefore, the petitioner is not entitled for the appointment on the post of Shiksha Mitra. 4. This Court finds that once it has already been held by this Court in Writ A No.14436 of 2019 that the appointment of the petitioner was void, therefore, the resolution passed by the Gram Shiksha Samiti, ignoring the orders of the Court, is bad in the eyes of law, hence, the prayer as made in the present writ petition is misconceived. 5. In view of the above, the writ petition lacks merit and accordingly stands dismissed. Order Date :- 20.8.2025/Rahul. Digitally signed by :- RAHUL GOSWAMI High Court of Judicature at Allahabad
