After arguing the matter at some length and on being confronted with the effect of the prayer made by the petitioner directing the respondent- Transport Commissioner to decide the pending appeal, which factum stands contradicted by undated document (Annexure P-14) appended by him and the pleadings made in para 4 thereof, learned counsel for the petitioner seeks withdrawal of the present writ petition with liberty to verify the facts and to file a fresh petition on the same cause of action with better particulars, if so advised.
