Page No.# 2/3 arrest in connection with Sessions Case No. 149/2024 arising out of Tezpur Police Station Case No. 100/2024 under Section 370 (4)/34 of Indian Penal Code, 1860.
2. Heard Mr. B. Sarma, learned Additional Public Prosecutor, Assam.
3. It is submitted that the allegation of human trafficking does not apply to the petitioner. An undertaking was executed by the victim’s father for handing over his 7 (Seven) years old daughter to the petitioner. Annexure-1 is the undertaking. It is submitted that the main accused in this case is Abdul Khalil who is the father of the victim. The informant is the mother of the victim.
4. Learned Additional Public Prosecutor has raised serious objection stating that the petitioner has been involved in illegal act of procuring children for her household chores. There are incriminating materials in the case record against the petitioner and she is not entitled to pre-arrest bail.
5. I have considered the submissions at the bar with circumspection. The petitioner is willing to cooperate with the trial.
6. The petitioner is hereby directed to appear before the learned Trial Court on or before 25.04.2025 and on her appearance, she shall be enlarged on bail on furnishing a bail bond of Rs.30,000/- (Rupees Thirty Thousand) with a suitable surety of like amount to the satisfaction of the learned Trial Court. The learned Trial Court may also impose conditions to secure the attendance of the petitioner.
