JUSTICE VIJAYKUMAR A. PATIL) This contempt petition is filed alleging the willful disobedience of the order dated 08.09.2023 passed in W.P.No.17651/2023. The respondent/accused has filed an affidavit dated 19.11.2025. The paragraph Nos.2 to 4 of the affidavit reads as under: "2. I affirm and state that as directed by this Hon'ble court immediately after the receipt of the order, we have sent the proposal to the Block Education Officer, Department of Education, Arkalgud Taluk, Arkalgud, Hassan District by its letter dated 15/09/2023 to release of arrears of salary due to complainant from 06/10/2022 to 08/09/2023. Copy of the letter - 3 - HC-KAR NC: 2025:KHC:49410-DB CCC No. 1099 of 2023 dated 15/09/2023 is produced herewith as document No.1. 3. I affirm that in response to our letter and as directed by this Hon'ble court, the department of Education has also released the arrears of salary to complainant on 27/10/2023. A copy of the salary released for the period from October 2022 to September 2023 are produced herewith as document No.2 to 12 and further the Department of Education is releasing her salary periodically every month. Copy of the salary release from September 2023 till December 2023 is produced herewith as document No.13 to 23. 4. I affirm that despite of receipt of arrears of salary as directed by this Hon'ble court the above contempt petition is filed only against the management as sole accused in the above case for alleged disobedience of the order of this Hon'ble court only with an intention to harass the management and after receipt of notice from this Hon'ble court and I came to know the facts of the case on the basis of the records made available in my office." 2. The aforesaid affidavit and annexed documents clearly indicate that the proposal as directed was forwarded by the accused to Block Education Officer, Department of Education, Arkalgud Taluk, Arkalgud, Hassan District. In view of the aforesaid assertions in the affidavit and documents enclosed along with the affidavit, we are of the considered view that there is no willful disobedience of the order of the learned Single Judge. Accordingly, the contempt petition is dropped. 4. It is needless to observe that if the management has taken any action subsequent to the order of the learned Single Judge, it is always open to the complainant to challenge the same in accordance with law.
