ORAL ORDER
1. The petitioner-mother of the detenu-Yogananda @ Yogi.S.V. [CTP No.01045] is before this Court seeking for the following reliefs; a. Direct the R2 to release the petitioner Yogananda @ Yoga S.V. CTP-01045 who is a convict lodged in Respondent No.2 Central Prison on general parole for a period of 90 days citing that his presence is essential to oversee repair work of the house which is in a dilapidated condition and also an previously he has not released on parole. b. Pass any other order(s) which this court may deem fit and proper under the facts and circumstances of the case, in the interest of justice.
2. The detenu had been convicted in S.C.No.18/2021 for offences under Section 449, 458, 396, 302 r/w 120B of IPC by the 4th Additional District and

Sessions Judge, Hassan, sitting at Channarayapatna and sentenced on 15.07.2024 with the highest of the sentence being imprisonment for life. The petitioner having made an application for parole, the same came to be rejected on account of two other criminal proceedings are pending against the detenu.

Learned counsel for the petitioner submits that in those two criminal proceedings bail has been granted to the detenu and that the detenu has been accorded emergency parole on earlier occasion when the detenu has surrendered to the police authorities. The detenu has served a period of 4 years 2 months 18 days of incarceration as on 26.11.2024.
4. Taking into consideration the conduct of the detenu has been satisfactory while incarcerated, there is no particular complaint against the detenu, I pass the following:
ORDER i) The Writ Petition is allowed.

ii) Respondent–Chief Superintendent, Central Prison, Bangalore, is directed to release the detenu- Yogananda @ Yogi.S.V. [CTP No.01045] on parole for a period of 60 days commencing from 22.12.2025, subject to the following conditions: a) The prisoner- Yogananda @ Yogi.S.V. [CTP No.01045] shall mark his attendance in the jurisdictional Police Station, weekly once throughout the period of his parole and it would be the responsibility of the jurisdictional Police to take them to gaol, in the event, the convict would evade going back to the gaol, after the expiry of the period of parole. b) Respondent No.1- State of Karnataka shall stipulate strict conditions as are usually stipulated to ensure return of the detenu to

the gaol and that he shall not commit any other offence during the period of parole. iii) The Registry is directed to communicate the
order to the prison authority for its immediate execution.
