Neutral Citation No. - 2025:AHC:144396 Court No. - 33 Case :- WRIT - C No. - 28359 of 2025 Petitioner :- Manoj Kumar Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Archana Yadav,Yogendra Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Prakash Padia,J.
1. The petitioner has preferred the present writ petition inter-alia with the following prayer:-
"i) Issue a writ order or direction in the nature of mandamus commanding the respondent No. 3 to register the name of the petitioner into the family register of his adopted father Late Subedar Singh in the village Mohanipur, Mauja Dakhinara, Tehsil Shikohabad District Firozabad forthwith, within stipulated period as fixed by the Hon'ble Court. ii) Issue a writ order or direction in the nature of mandamus commanding the respondent no.3 to decide the pending application of the petitioner dated 19.07.2025 by a reasoned and speaking order, within stipulated period as fixed by the Hon'ble Court."
2. It is argued by the counsel for the petitioner that the petitioner is adopted son of Late Shri Subedar Singh on the basis of Registered Adoption Deed dated
03.12.1994. It is further argued that in various revenue records the name of Shri Subedar Singh is duly mentioned as father of the petitioner. It is further argued that for the purpose of his name in the family register, the petitioner submitted an application before the Respondent No.3, District Panchayat Raj Officer, Firozabad in the year 2021. On the said application the remarks were made by ADO (Panchayat), Sikohabad on 18.08.2021 directing the Secretary to do the needful in the matter. 3. It is argued that considerable time has already been lapsed but till date no decision has been taken, hence the present writ petition. 4. On the other hand it is argued by the learned Standing Counsel that the respondent no.3 will take a decision in the matter, expeditiously, if such application is moved before the Respondent No.3 as per Rule 6 of the U.P. Panchayat Raj Maintenance of Family Register (Rules 1970). 5. Heard counsel for the parties. 6.
With the consent of the counsel for the parties and also in the interest of justice,
the present writ petition is disposed of finally permitting the petitioner to submit an application annexing the copy of the earlier application submitted by him on which the remarks were made by the ADO Panchayat, photocopy of which is appended at page-48 to the writ petition before the Respondent No.3, Assistant Development Officer, (Panchayat), Firozabad within a period of two weeks from today. If it is so, the Respondent No.3 is directed to pass appropriate order on the same, most expeditiously and preferably within a period of six weeks thereafter.
