ORAL ORDER
This petition is filed by accused No.1 under Section 482 of BNSS praying to grant anticipatory bail in Crime No.76/2025 of Police Station, registered for offences under Sections 318(4), 316(2), 336(2), 336(3), 204 read with 3(5) of BNS. 2. Heard learned counsel for petitioner and learned HCGP for respondent/State. 3. Learned counsel for the petitioner would contend that the complainant and his sister have released their rights in the joint property in favour of this petitioner by a registered release deed after receiving a consideration of Rs.5,00,000/- each. The complainant and his sister have now challenged the said release deed in O.S.No.647/2025 and it is pending and this petitioner is contesting the same. The petitioner is ready to co-operate with the police

in investigation. The petitioner has not forged any signature of the complainant and his sister. With this, he prayed to allow the petition. 4. Per contra, the learned HCGP would contend that the petitioner forged the signature of his mother and sister and created the release deed in the guise of getting executed mortgage deed. The investigation is in progress. The petitioner is required for custodial interrogation. With these, he prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused the FIR, complaint and other materials placed on record. 6. The petitioner, complainant and sister of the petitioner are joint owners of the property and after death of the father of the petitioner, the complainant and sister of this petitioner is stated to have executed registered release deed in favour of this petitioner. It is alleged that the petitioner, in the guise of getting executed mortgage deed, got executed the release deed and forged the

signature of the complainant and his sister. The suit filed by the complainant and the sister of this petitioner in O.S.No.647/2025 challenging the said registered release deed is pending and this petitioner is party defendant contesting the same. The petitioner has undertaken to co- operate with the IO in the investigation and abide by any conditions imposed by this Court. The offences alleged against the petitioner are not punishable either with death or imprisonment for life. The petitioner is not having any criminal antecedents. 7.
Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions. In the result, the following:
ORDER
The petition is allowed. The petitioner is ordered to be released on bail, in the event of his arrest, in Crime No.76/2025 of Ijoor Police Station, subject to following conditions:

(i) Petitioner shall voluntarily appear before the IO within 10 days from this day and execute bail bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the IO.
(ii) Petitioner shall co-operate with the IO in the investigation and appear before the IO whenever called for.
(iii) Petitioner shall appear before the IO on first and third Sunday of every month for a period two months or till filing of the final report, whichever is earlier.
