Heard Ms. Priyanka Shukla and Mr. Sachin Nidhi, learned counsel for the petitioner as well as Mr. S.S. Baghel, learned Deputy Government Advocate, appearing for the State / respondents. 2. The present writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking following reliefs : “(i) It is therefore prayed that this Hon'ble Court may kindly be pleased to issue an appropriate writ/order/direction to the Respondent Authority to take an appropriate action on the complaint filed by the petitioner as per the provision of law. (ii) That, the Hon'ble Court may kindly direct the police authority to done fair investigation and call records of the petitioner may also be enquired for the proper inquiry as per provision of law. (iii) That, the Hon'ble Court may kindly direct the Collector, Mungeli (C.G.) to conduct a fresh election for the post of Sarpanch at Gram Khutera & Panchayat Khutena Tahsil & P.S.- Pathariya, Dist.- Mungeli (C.G.) and the election must be conduct in a transparent manner and in without under the influence of the any person, in the interest of justice (iv) Any other relief which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case be also granted.” 3 3. Learned counsel for the petitioner states that after filing of the present petition, FIR on the basis of complaint filed by the petitioner has already registered. 4. In view of the same, we are not inclined to entertain the present matter at this stage. 5. Accordingly, the present writ petition is dismissed leaving it open to the petitioner to pursue the FIR which has been lodged his instance.
