By means of the present C528 application, the applicant has put to challenge the summoning order dated 02.04.2024, passed by learned Judicial Magistrate/IIIrd Additional Civil Judge, Haridwar along with entire proceedings of Complaint Case No.355 of 2024 (old complaint case no.167 of 2024), Dr. Sushil Kumar Vs. Sachin Chaudhary, under Sections 499 and 500 of IPC as well as entire proceedings of the aforesaid criminal case pending in the court of learned Additional Chief Judicial Magistrate/IInd Additional Chief Judicial (S.D.), Haridwar. 2. It is contention of learned counsel for the applicant that in the complaint, which is annexed as annexure no.1, the allegations are only against the hospital and not against the Doctors, who run that hospital, therefore, the complaint is not maintainable and can be thrown at the very threshold. He further submits that provisions of Section 499 of IPC are not attracted as per the complaint. 3. Having heard learned counsel for the applicant and having gone through the C528 application, in totality, including the complaint, this Court is of the opinion that, prima facie, offence is made out, therefore, summoning order has rightly been issued against the applicant. 4. Para no.2 of the complaint is relevant, which is extracted 2025:UHC:269 2 below:- “यह Ǒक सिचन चौधरȣ पुğ सुरेश चौधरȣ िनवासी गली नम्बर 3 लेफ्ट साइड खन्ना नगर ज्वालापुर ǔजला हǐरƮार मो० नं0-9917312155 जो Ǒक राजनैितक व्यǒƠ है, जो Ǒक Ĥाथȸ के हॉǔस्पटल से थोड़ȣ दूर हȣ रहता है, और अपने आप को राजनैितक पाटȹयɉ का सदस्य बताता है और ǒवपक्षी ने अपना फे सबुक खाता/Ĥोफाइल सिचन चौधरȣ नाम से बनायी है। ǒवपक्षी हमेशा Ĥाथȸ व Ĥाथȸ के हॉǔस्पटल कȧ छǒव धूिमल करने के िलए अपने फे सबुक खाते पर Ĥाथȸ व Ĥाथȸ के हॉǔस्पटल पर आपǒƣजनक पोस्ट Ǒदंनाक 25.09. 2023 मɅ दाǔखल करते हुए अपने फे सबुक खाता उपरोƠ पर अपने साथ 8 अन्य लोगो को टैग करते हुए पोस्ट िलखकर वायरल कȧ, ǒवपक्षी ने देवभूिम अस्पताल रानीपुर मोड़ नया हǐरƮार मे मरȣजो कȧ ǔजंदगी पर भारȣ है उनकȧ जेब कȧ भरपायी शायद हǐरƮार मɅ जनसेवा को सबसे ज्यादा व्यवसाय इसी अस्पताल ने बनाया है नहȣं बनाने दɅगे जनसेवा को व्यवसाय ये बात वहां का Ĥबंधक गाठ ले जल्दȣ हȣ होगा टकराव वाǒपस आने पर व एक और पोस्ट अपने साथ 16 लोगो को टैग करते हुए िलख कर वायरल कȧ ǔजन भी अस्वस्थ व्यǒƠओ या उनके पǐरजनɉ को न्यू देवभूिम अस्पताल नया हǐरƮार से Ǒकसी भी Ĥकार कȧ परेशािनयɉ से जैसे कȧ मरȣजो से दुव्यर्वहार या उनके पǐरजनɉ से दुव्यर्वहार या उिचत उपचार नाkkkkkkkkkkkkkkkkkkkkkkkkkkkk Ǒदया जाना या स्टाफ के Ʈारा अभġता करना या कु छ ओर बता कर कु छ ओर Ǒकया या अन्य Ǒकसी भी Ĥकार से वे परेशान या दुखी हुए हो तो कृ iiiiiiuiiiiiiiiiiiiiiiiiiiiiiiiiiiiiपया मेरे नम्बर पर अवगत कराये 7456906907 करते हुए Ĥाथȸ व Ĥाथȸ के हॉǔस्पटल कȧ छǒव खराब करते हुए पोस्ट Ǒकया |” 5. In view of the aforesaid observation, this Court is of the view that no case is made out to interfere in the matter. 6. Accordingly, C528 application is dismissed in limine.
