The petitioner filed a private complaint against the respondent for the offence under section 138 of the Negotiable Instruments Act. The respondent was convicted for the offence under section 138 of the Negotiable Instruments Act and by the judgment dated 02.07.2024 and he was sentenced to under go simple imprisonment for six months and to pay compensation of Rs.11,42,000/- in default to undergo simple imprisonment for three months. As against which the respondent had filed an appeal in C.A.No.36 of 2024. The grievance of the petitioner is that though he was cheated in the year 2019 and respondent was convicted in the year 2023, he was not able to realise the money borrowed by the respondent.
