2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 274/275/317(5) of the Indian Penal Code and section 30a of the Bihar Prohibition and Excise Act.
3. As per the prosecution case, 16.5 liters illicit liquor was recovered from the tempoo of which petitioner is the registered owner.
4. Learned counsel appearing for the petitioner submits that no incriminating material has been recovered from the conscious possession of the petitioner and he has falsely been implicated in this case on suspicion. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail. He submits that petitioner is the owner of the vehicle
Patna High Court CR. MISC. No.2208 of 2025(3) dt.07-04-2025 2/2 from which there is recovery of illicit liquor, as such, he cannot escape responsibility.
6. Considering the aforesaid facts, prayer for bail of the petitioner is refused.
