(ORAL) CM No. 9594-C-2025 (i) Application for placing on record a copy of the compromise deed, dated 03.06.2025/22.07.2025 as Annexure A-2, an affidavit of respondent–Santosh, and an affidavit of Smt. Santosh (who is the sole legal representative of appellant No.1–Piara Singh and is arrayed as appellant No.2 in the present appeal), as Annexures P-3 and A-4 respectively, with the main appeal is allowed, as prayed for. (ii) The aforesaid compromise deed and affidavits are taken on record as Annexures A-2 to A-4, subject to all just exceptions. (ii) For the reasons stated in the application, which is duly supported by an affidavit of appellant No.2-Lalita, the same is allowed. Accordingly, the date of hearing fixed in the accompanying appeal is advanced from 27.08.2025 to today. The main appeal is taken up on Board. RSA No. 4359 of 2016 (O&M) 1. Both learned counsel for the parties are ad idem that a compromise, dated 03.06.2025/22.07.2025 (Annexure A-2) has been effected between the parties, and that they shall remain bound by the terms and conditions thereof. 2. Learned counsel appearing for the appellants submits that she may be permitted to withdraw the present appeal, in terms of the aforesaid compromise, dated 03.06.2025/22.07.2025 (Annexure A-2). 3. Keeping in view the observations made hereinabove, the present appeal is dismissed as withdrawn. 4. Pending miscellaneous application(s), if any, shall also stand disposed of.
