This is an office reference. 3. This suo moto public interest litigation petition has been registered on the basis of news report published in Hindi Daily Newspaper, namely, Dainik Bhaskar, on 06.02.2025 with a caption 'fuxe ,slh ukyh cuk jgk gS fd 15 ifjokj ds 50 yksx vius gh ?kjksa esa dSn'. A photograph has also been published alongwith the said newsreport which states that just before coming into force the model code of conduct, the Municipal Corporation, Bilaspur, has issued work order with respect to the tender floated for construction of drainage in Ward No. 19, Kasturba nagar. The contractor has started the digging work and the rubble and debris are lying on the road which is causing obstruction in commuting through the said street and the people living in the locality are constrained to remain inside their houses which has created a situation of house arrest for 15 families. The length of the drain is about 70 meters but no temporary arrangements have been made by the contractor concerned to facilitate entering into the house as a long trench has been dug. The present Ward Councillor is busy 3 in the forthcoming Municipal elections and no one is taking the matter seriously. Even the authorities have turned deaf ears. 4. In compliance of the Court’s order dated 07.02.2025 the Commissioner, Municipal Corporation, Bilaspur has filed his personal affidavit which is reproduced hereinbelow:- “1. That, the deponent respectfully submits that he is a law abiding citizen of India and has the Highest regards and greats respect for this Hon’ble Court and its order. He respectfully submits that he cannot even dream of flouting the orders passed by this Hon’ble Court. 2. that, the last date of hearing on 07.02.2025 this Hon’ble Court is directed that “we deem it appropriate to direct the Commissioner, Municipal Corporation, Bilaspur to file his personal affidavit with respect to the above issue before the next date of hearing. 3. That, the office of the Zone Commissioner 3, Municipal Corporation, Bilaspur, issued a work order dated 06.11.2024 regarding the construction of the new concrete drainage and chabutara, etc. in ward no.19. A copy of the work order letter dated 06.11.2024 is marked and annexed herewith as Annexure R-5/1. 4. That the photographs of the particular lane of ward no.19 which clearly demonstrate that the construction of drainage is completed even the construction material which was put among the lane that has been also remove and clean. A copy of photocopy of lane is marked and annexed herewith as Annexure R-5/2 (Colly). 4 5. It is stated by learned counsel appearing for respondent No.5 that construction of drainage has been completed and even the construction material which was put among the lane has been removed and cleaned. 6.
