Petitioner is serving as Assistant Teacher, L.T. Grade (Social Science). She was transferred from Government Inter College, Bhimawala, Dehradun to Government Inter College, Mahadjali, Devprayag, District Tehri Garhwal, vide order dated 26.06.2023. Feeling aggrieved by her transfer, she filed this writ petition. 4. Coordinate Bench passed interim order in favour of the petitioner on 11.07.2023, on the ground that petitioner’s husband is suffering from Fahris disease, which is a rare neurological disorder, due to which he is 45% disabled. 5. Learned counsel for the petitioner submits that petitioner was transferred, as she had served for more than fifteen years at sugam places at the time of her transfer and as of now, she has served for more than seventeen years in sugam places. He further submits that petitioner had not 2025:UHC:8878 indicated the list of desired stations where she wanted to be posted, therefore having regard to the provisions of the Transfer Act, she was transferred to Government Inter College, Mahadjali, Devprayag, District Tehri Garhwal. He further submits that disability suffered by the spouse cannot be a ground for challenging transfer made under Transfer Act. 6. Learned State Counsel, however, fairly submits that if petitioner has any grievance against her transfer, then she can approach the competent authority by making a representation. 7. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the Regional Additional Director, Pauri. If she makes representation within one week from today, the Regional Additional Director shall take decision thereupon within three weeks thereafter. 8. For a period of four weeks or till decision is taken, whichever is earlier, status quo qua petitioner’s posting shall be maintained.
