JUSTICE SANDEEP KUMAR ORAL ORDER 2 05-02-2025 Heard the learned counsel for the petitioners and learned APP for the State. 2. The petitioners seek regular bail in a case registered for the offence under Sections 304/34 of the Indian Penal Code. 3. As per the prosecution case, petitioners along with other co-accused persons are said to have killed the deceased. 4. Learned counsel for the petitioners submits that petitioners are innocent and they have not committed any offence. They are in custody since 01.10.2024. He further submits that other co-accused persons have been granted bail by this court vide order dated 31.01.2024 passed in Cr. Misc. No. 3412 of 2024. Patna High Court CR. MISC. Considering the aforesaid facts and circumstances, this application for regular bail is allowed. 7. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned J.M.F.C. (East), Muzaffarpur/concerned Court below in connection with Ahiyapur P.S. Case No. 08 of 2019 subject to condition that:- 7(i) The petitioners shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non- cooperation in the trial shall result in cancellation of the bail bond of the petitioners.
