GP FOR HOME The Court made the following: 2 ORDER:- The learned counsel for the petitioner submits that the petitioner is arraigned as the 5th accused in Crime No. 410 of 2024 on the file of the Rajanagaram Police Station, East Godavari District, for the alleged offences under Sections 8(c), r/w 20(b) (ii) (B), 27(a) of the NDPS Act, r/w 34(a) of the Andhra Pradesh Excise Act (APEA). 2. It is submitted that the petitioner was not available at Rajanagaram on the date when the offence took place. It is submitted that the petitioner stayed at VIOLA SUITES situated in Madapur, Hyderabad, and requested the police to take the CCTV footage of the hotel from 08.10.2024 till 11.10.2024, which would establish that he was at the hotel during that point of time. It is also submitted that the police are not considering his request. 3. The learned Assistant Government Pleader submits on instructions that the petitioner was available on 10.10.2024 and was also involved in the alleged offences. The photographs produced by the learned Assistant Government Pleader indicate that a birthday party was held, and a cake-cutting ceremony took place. 4. Be that as it may, the ends of justice would be met if the police investigate the issue in its totality and also secure the CCTV footage from VIOLA SUITES, situated in Madhapur, Hyderabad. 3 5. The learned counsel for the petitioner submits that the petitioner has also filed the bills for his stay, having checked in on 08.10.2024 and checked out on 10.10.2024. 6. Considering the same, this Writ Petition is disposed off, directing the Station House Officer/Investigating Officer in Crime No. 410 of 2024 on the file of Rajanagaram Police Station, East Godavari District, to secure the CCTV footage in VIOLA SUITES, situated in Madhapur, Hyderabad, from 08.10.2024 till 11.10.2024, if they are available, for the purpose of investigation of the crime.
