Mr. Satyendra Tiwari, learned A.G.A. appearing for the State, points out that the affidavit is sworn by Shubham Pandey, who happens to be friend of the applicant, which is not permissible in view of the orders of this Court. Even otherwise, the bail rejection order mentions about the alleged pairokar, namely, Kanchan Singh, who sworn the affidavit on behalf of the applicant before the court below, wherein also fraud is said to have been played. On the aforesaid submissions, learned counsel for the applicant prays to not press the present bail application. In view of the above, the bail application is dismissed as not pressed.
