The present criminal appeal under Section 14-A(1) Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act has been preferred to set aside the summoning order dated 11.06.2025 passed by Special Judge (SC/ST Act,) Jaunpur in S.S.T. No. 267 of 2025 (State Vs. Rakesh Tiwari) arising out of Case Crime No. 326 of 2022, under Sections 504, 323 I.P.C. and 3(2) 5A of Scheduled Castes and The scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station- Badlapur, District- Jaunpur with a further prayer to stay the further proceedings of the S.S.T. No. 267 of 2025 (State Vs. Rakesh Tiwari) arising out of Case Crime No. 326 of 2022 U/s 504, 323 I.P.C. and 3(2) 5A of Scheduled Castes and The scheduled Tribes (Prevention of Atrocities) Act, 1989, Police Station Badlapur, District Jaunpur. 3. During arguments, learned counsel for the appellants has submitted that he does not want to press the prayer for setting aside the summoning order as well as entire proceedings of the above mentioned case. His sole prayer is that a direction may be issued to the court below to decide the bail application of the appellants in accordance with law. 4. Considering the alternative prayer made by learned counsel for the appellants, the present appeal is disposed of with the direction that in case the appellants filed bail application before the court below, the same shall be heard and decided by the court below expeditiously in accordance with law.
